Lawfare Flares Up as a First Suit by Vaxx Injured Germans vs. BioNTech moves to Discovery

Lawyers Rogert & Ulbricht--of 'Dieselgate' fame--claim that VAIDS is 'not a condition but a description of the state-of-affairs' following mRNA injection; note that this was reported by legacy media

At certain moments in time, I’m beginning to feel a bit more hopeful about the future—especially if I see reports, in legacy media, no less, like the one reproduced below. Hat-tip to Peter Mayer at tkp who posted about this first.

Due to Vaxx Injuries, Düsseldorf Law Firm Sues BioNTech

In a first, the Covid-19 vaccine manufacturer BioNTech has been sued for possible vaccine damage. As the law firm Rogert & Ulbrich from Düsseldorf reports, it has not been able to reach an out-of-court settlement with BioNTech and has therefore filed six-figure lawsuits in several matters.

According to the lawyers, the background is the behaviour of the manufacturer of the injectable product, Comirnaty. In response to claims for damages and information, BioNTech had only sent a form instead of a letter dealing with the facts of the case. The form asked for the written basis of the claims to be submitted on a Pfizer form.

Lawyers accuse BioNTech of disrespectful treatment of vaccination victims

According to the lawyers, this behaviour is unusual and they consider it disrespectful. ‘The injured parties feel that they are not being taken seriously. They are not only plagued by considerable, life-limiting health problems since the vaccination. Now the company responsible is arrogantly giving them the cold shoulder instead of fulfilling its responsibility’, says Marco Rogert, founding partner of the law firm.

His clients had already approached the European Medicines Agency (EMA), the Paul Ehrlich Institute, and BioNTech to inform them about their woes. ‘Especially in cases involving considerable damage to health, the least victims can expect is that the facts of the case are dealt with seriously’, the lawyer [Mr. Rogert] added.

Lawsuit against BioNTech: Lawyers doubt legality of Corona measures

For lawyer Tobias Ulbrich, a link between Corona vaccination and various diseases is clear: ‘More and more vaccine damages are coming to light worldwide, and many vaccinated people are only now beginning to realise that their current illnesses are related to the mRNA injection.’

According to Ulbrich, the Pharmaneutics Act [Arzneimittelgesetz] stipulates that it is not the vaccinated person who has to prove whether the vaccine damage is due to the vaccination. It is the other way around: the vaccine manufacturer is responsible. The vaccine manufacturer must prove that there is no connection to the vaccination. ‘It is therefore all the more astonishing that BioNTech does not immediately seek a settlement in the few reported cases of damage’, says Ulbrich.

The law firm Rogert & Ulbrich challenged the legality of measures during the height of the Corona pandemic. Among other things, the lawyers accused the government of unlawfully sending travellers back to quarantine. The law firm became known through the diesel emissions scandal at VW. At the time, the lawyers won many judgements in favour of the plaintiffs.

Bottom Lines

All told, this is quite a move—not only because the lawyers of Rogert & Ulbricht managed to break through the legacy media blackout (at least partially) by getting the Kölner Stadtanzeiger, the bourgeois daily of the metropolis of Cologne, to report on this matter.

In addition, Rogert & Ulbricht are no strangers to multi-million lawsuits, as their successes in what is known as ‘Dieselgate’ (Volkswagen’s year-long scam to defraud its customers and regulators due to manipulated emissions software), hence, if I’d be working for BioNTech, I’d take them seriously.

Furthermore, the article also informs us that BioNTech—certainly advised by Pfizer—declined to settle out of court. This is very interesting, as this is the functional equivalent of the case at some point moving to the ‘discovery’ stage, i.e., public court proceedings. It will be quite interesting to see how well BioNTech and Pfizer will comply with judge’s orders to explain themselves.

That said, moving to this stage of court proceedings does not, in and of itself, preclude the option of an out-of-court settlement at a later stage. Still, I’d say that this is certainly a step in the right direction towards the restoration of the rule of law. While it’s quite early days, certainly way too early to call this one, it’s indicative of a possible wind of change that might be picking up in Europe, however light it might seem right now.

If you know lawyers (personally), they are not a very chatty bunch of people in public—as long as they don’t have the facts checked out. For Mr. Ulbricht posting the above on 28 Aug. 2022, I’m pretty sure he double- and triple-checked the scientific data to make sure he can’t be sued for defamation, libel, or the like by BioNTech or Moderna.

If I’d be working for Big Pharma, I think I’d begin to worry quite a bit.
