Covidistan Annals XXIV: Mückstein flip-flops, all advantages are with the ÖVP now--and the DoJ reminds the régime that forced injections are criminal

Justice Minister Zadić's letter from 9 Feb. 2022 puts the entire political class that voted in favour of the Injection Mandate on notice: let's all find lawyers and file criminal charges *now*

As noted in my previous post, Health Minister Mückstein elected to ignore the official information request by Constitutional (Supreme) Court Judge Andreas Hauer. So, in this post, I shall endeavour to briefly update you on current events and try my soothsaying skills in determining what might happen next.

Mückstein Speaks (vs. ‘the Experts’)

but he went on national public radio earlier today to maintain that, for him, nothing the Committee of Public Safety has done earlier this week—i.e., the revocation of most mandates in the next two weeks until 5 March—would have any bearing on the injection mandate:

We’ll enter phase 2 on 15 March, and, according to the expert panel’s recommendation, thereafter we’ll move to phase 3.

Speaking of this expert panel, Chancellor Nehammer nominated the four-person panel just yesterday, which consists of MDs Eva Schernhammer (an epidemiologist) and Herwig Kollaritsch (an infectious disease specialist), as well as JDs Karl Stöger (medical law) and Christiane Wendehorst, according to a write-up by ORF.

Now, we’ve encountered Dr. Kollaritsch before and he’s been quite outspoken when it comes to being against revocation of the mandates as recently as three weeks ago. A couple of weeks earlier, in mid-January, I wrote this about him:

On 10 Jan., infectious disease specialist Herwig Kollaritsch, MD went on the nightly news and opined that a postponement of the vaccine mandate is still on the books. At the latest, he cautioned, the law must be operational by late May ‘to have any impact on future autumn waves’. Kollaritsch further noted that the vaccine mandate wouldn’t do much, if anything, against Omicron.

So, before you accuse Kollaritsch of flip-flopping, remember: he’s an academic (and I know that kind of ilk) craving for his 15 minutes of fame, hence it’s fair to assume that he’ll do and say virtually anything to get him onto national TV or the like. (Most academics are like this, believe me, I’m one of them, and while I won’t rule out I’d do the same, I so despise these court stenographers masquerading as journalists that, if invited once, I’d probably won’t be asked again.)

According to the above-linked ORF piece, these four experts—Drs. Schernhammer and Kollaritsch, as well as jurists Stöger and Wendehorst—have all been on the record for weeks on end that ‘some modifications’ of the injection mandate may be necessary.

Remember: the Injection Mandate is an Enabling Act

I’ve said it before—and I’ll gladly repeat it here—Covidistan’s Health Minister is one of the most despicable creatures among the unsavoury cast of characters that pretend to be in charge since the Covid Purge commenced last autumn. Upon publication of the draft of the injection mandate—that bears his name (shame)—I provided you with a translation of its main clauses as well as my estimation. Published few days before Christmas, here’s what I wrote (and I stand by this; emphases mine):

If you read the key titles and sections carefully, one can see that this is not a public health measure. It is, frankly, a piece of Enabling Legislation (Ermächtigungsgesetz) that is both unwarranted and irresponsible…

this is an abomination and in a sane world, any such crap would never see the light of day. In the clown world masquerading as ‘pandemic response’ in Covidistan, this Act will be voted on in late January and enter into force on 1 February 2022 [corr.: 4 Feb., due to the unprecedented number of public comments]

In my afterthoughts, I argued that ‘that this piece of legislation is the hill the Covidistan régime is making its last stand on’. Furthermore, I also held that one of the rotten apples in this particular barrel would be the ‘militarisation of Covid policies’, which is clearly visible in last Wednesday’s [17 Feb.] press conference: the political hacks (Nehammer, Mückstein) announced the coming end of the mandates while Maj. Gen. Striedinger insisted that a fourth injection will be mandatory in summer.

In my pre-Christmas piece, I also wrote that

once this Enabling Act is enshrined into law, we will see the emergence of a ‘unity government’ to forestall any elections before the current parliamentary term expires in autumn 2024.

It would appear that this may be only partially true, according to increasingly numerous rumours and legacy media pieces about a snap election later this year. Still, anyone’s chances at the polls is contingent on all matters Covid-19, as recent data suggests: seven out of ten are ‘unhappy’ with the current government, with current electoral polling (n = 800, ± 3.5%) showing the Social Democrats at 25% (i.e., no changes), the ruling ÖVP at 24% (2019: 37.5%), the Freedom Party stood at 18%, the Greens at 13%, NEOS at 10%, and—the new pro-freedom and liberties party MFG at 7%. These data is from 7-10 Feb., i.e., prior to the above-related changes (the injection mandate decree by Mückstein and the envisioned revocation of many mandates).

Given these recent changes, I’d add that the most immediate consequence is that everyone who’s currently on the Committee of Public Safety is, well, expendable, politically speaking. This applies, above all, to the author of the Enabling Act, Health Minister Mückstein.

Mückstein ‘Retracts’ (after speaking on national radio)

Hence, at this point, it won’t surprise you that Mückstein virtually immediately backpedalled his absurd comments (related at the top of this piece). Here’s how state broadcaster ORF tried to frame it (my emphasis):

In a written ‘clarification’, issued on Saturday afternoon, Health Minister [Mückstein] emphasised the flexibility of the injection mandate with respect to its implementation. The expert panel will recommend when phase three will enter into force, perhaps only come autumn. Mückstein: ‘If, within the framework provided by the Act, there are recommendations pertaining to the key dates envisioned by the Act, then these [recommendations] are to considered politically, and any decision thereafter must also be political.’ Thus Mückstein now showed himself open about when to actually enforce the provisions of the Act.

You see, I’ve been on the record for quite some time now that ‘Covid-19’ is, above all, a political issue, and here you have the putschist Mückstein confirming it.

As such, it’s almost comically absurd that members of the same régime-appointed expert panel had told the public that ‘we will certainly not accept any intervention whatsoever’, and they did so less than twelve hours earlier.

Legal scholar Karl Stöger, on Friday, had floated the ‘idea’ of re-writing the injection mandate in a way that it would apply ‘only’ for certain groups or industries. Examples mentioned were, of course, healthcare workers as well as kindergarten and primary school teachers.

At this point, I’ll spare you the rest of the comments in the legacy media; what I’ll do instead is that I shall point you to a recent paper by Regev-Yochay et al. who have run a very limited, underpowered, and oddly-designed study on—healthcare workers and the fourth injection.

Guess what—the paper, by its own admission, failed in particular with regard to making the case for a group-specific fourth injection: ‘The major objective for vaccinating HCW [with a fourth injection] was not achieved.’ See my full take here.

Nehammer to Go All-In for the ÖVP

Chancellor Nehammer and designated ÖVP chair is now in full control of these matters. I suspect that his Green counterpart, Vice Chancellor Kogler, is drowning in self-pity and sorrows for himself and his party.

Nehammer, ever the creature of the all-powerful Lower Austrian state party, will soon fully switch to ‘save the party, let the country go to hell’ mode. The appointment of four sly and wily experts to a panel under the aegis of the Chancellery suggests that Nehammer will weaponise Mückstein’s medico-fascist enabling legislation against the ÖVP’s domestic political opponents next.

Anyone who doubts this should go back and read my February pieces on the flip-flopping of most of these ‘experts’, accompanied by the oddities and inanities spewed by the régime’s loose cannon, Health Minister Mückstein. The latter appears quite incapable of reading between the lines, the writings on the wall, or answering the Constitutional Court’s questions. In other words: a large-scale change is in the making.

About the Court’s Questions—and why it may not matter

Lest I forget, one more brief segment on Mückstein’s contemptuous handling of the Constitutional Court’s questions. This is certainly something that shows, for everyone with an inkling of influence and power, that Mückstein’s time is up. This is something that cannot be allowed to become normalised, if only because ‘the legal system’ is such a wonderful tool in the hands of corrupt party hacks. I suspect that the first domino to fall, sooner rather than later, will be Health Minister and wannabe medical tyrant Mückstein (and good riddance to him).

If you’d wonder what might be in store for him, let me take you by the hand and on a short trip down memory lane.

You see, back in early December 2021, when Mückstein first floated the draft of the injection mandate, an intrepid Freedom Party MP by the name of Gerald Hauser, sent a long list of questions pertaining to the Nuremberg Code to the Department of Justice. The document bears the no. 8936/J-NR/2021 and is dated 9 Dec. 2021, and its original can be accessed in the bowels of the Parliament’s website. Here are the 21 questions by Mr. Hauser (shout-out to Chris Veber, who also reported on this):

1. Are the government’s activities with respect to the Covid injections ethically sound?

2. Under 1) of the Nuremberg Code we read that the ‘voluntary consent of the human subject is absolutely essential’. Was this consent given by every single individual injected with the experimental Covid-19 vaccines?

3. How would you consider the enormous pressure on the unvaccinated in light of the Nuremberg Code?

4. Was there any kind of convincing employed to make people take the Covid-19 injections?

5. Were all individuals comprehensively informed about this experiment?

6. Were, upon consenting, all individuals informed about the length of the experiment?

7. Were all individuals informed about the aims of the experiment?

8. There is an obligation, on part of those responsible for such an experiment, to determine whether informed consent has been given. As neither rights nor duties can be delegated to a third party, who was the person that ordered this experiment and who, in the final analysis, bears responsibility?

9. As every single natural person must be legally capable of rendering informed consent, please explain this with respect to minors [those under 18].

10. As every single natural person must be legally capable of rendering informed consent, please explain this with respect to individuals under the age of 12.

11. As every single natural person must be legally capable of rendering informed consent, please explain this with respect to disabled individuals.

12. Any experiment must be planned to include, and in part be based upon, animal studies as well as scientific knowledge about both the illness and its cause; both factors must appropriately inform the design of such an experiment: did all of these occur?

13. Have the Covid-19 injections been tested in animal studies?

    a) if no, why not?

    b) If no, how can we be sure that these products are suitable for the use in humans?

    c) If yes, what were the results [of the animal studies]?

    d) If yes, how long and what animals were involved in the testing of each of the Covid-19 injections?

14. Is it possible to declare oneself outside the responsibilities enshrined in, and de facto un-resonsible for failing to adhere to, the Nuremberg Code?

15. According to 8) of the Nuremberg Code, any experiment (by which in this case is meant the administration of experimental injections) involving humans may only be carried out by qualified and trained individuals. Is this the case in Austria?

    a) Are all doses and injections administered by academically trained staff?

    b) Who bears overall responsibility for the administration of the experimental Covid-19 injections in Austria?

16. According to 9) of the Nuremberg Code, each and any participant of an experiment may at any time and on his or her own volition withdraw from such an experiment. Is this guaranteed in Austria?

    a) If yes, how is this guaranteed?

    b) If no, will this situation be changed immediately?

17. According to 10) of the Nuremberg Code, if there is even the suspicion of serious adverse reactions or death, the experiment is to be terminated immediately. As of this writing, there were thousands of deaths worldwide—when will this experiment be terminated?

18. According to 10) of the Nuremberg Code, if there is even the suspicion of potentially serious adverse reactions or death, the experiment is to be terminated immediately. As of this writing, there were countless (millions) of adverse reactions worldwide—when will this experiment be terminated?

19. Does the risk of Covid-19 injection among children outweigh the benefits of the injections?

    a) If yes, why are these injections carried out?

    b) If yes, why is there a campaign to pressure children and teenager to get injected, as well as parents to get their children and teenager injected?

20. If there were infringements of the Nuremberg Code, public servants who learn of such infringements are obliged to act and notify authorities accordingly.

    a) What has been done by those in authority over public servants in this regard?

    b) Will there be now—per this

21. When and where was the Sars-Cov-2 virus isolated?

So far Mr. Hauser’s very own laundry list of questions, most of which, though, it must be said, were actually appropriately addressed to the Department of Justice as they pertained to legal matters.

In her reply, Covidistan’s Justice Minister, Alma Zadić—an Ivy League-trained (brainwashed) corporate hitwoman turned Green (of all) party hack who is actually quite qualified to oversee the administration of justice (bio here; note both her LLM, which was awarded by Columbia University, and her subsequent eight years at Freshfields Bruckhaus Deringer)—didn’t really answer the questions individually.

What she did, and perhaps inadvertently so, was something else entirely (emphasis mine):

The ‘Nuremberg Code’ was crafted in the aftermath of the Nuremberg Doctors Trial, which saw the dispensation of justice against members of the National-Socialist medical establishment. I resent the fact that the fate of the countless victims of these [Nazi] crimes and misdeeds is ex post, and inappropriately so, brought up in comparison with those people who are not vaccinated against Covid-19.

As regards the particular questions that fall into the DoJ’s responsibility, it shall be noted that, according to both Austrian Criminal and Civil Law, medical interventions may only be undertaken with the consent of the fully capable patient, irrespective of whether he or she may be an adult, a minor, or a disabled person (§§ 173 and 252 ff ABGB [the Austrian Civil Code], § 110 StGB [Criminal Code]).

In other words: Ms. Zadić may have put the entire government, the 80% of MPs who voted for this abomination of the injection mandate, and all public servants on notice.

A Call to Action—A Trolling Recommendation

Irrespective of what the expert panel now recommends, I suspect that every citizen should now file a criminal complaint against Mr. Nehammer, Mr. Mückstein, and literally everybody else who supported the injection mandate.

These people broke a number of laws, and they should be held accountable.
